Terms of Service — Machines Bazar

1.Acceptance of terms

By accessing or using Machines Bazar (the "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Platform. We may update these Terms from time to time; continued use constitutes acceptance of the updated Terms.

2.Eligibility

You must be at least 18 years old and capable of entering into a legally binding contract under Indian law. Sellers must be a registered business entity with valid GST and PAN where applicable.

3.Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately of any unauthorised use. We may suspend or terminate accounts that violate these Terms.

4.Buyer responsibilities

Buyers may browse listings and submit Requests for Quotation ("RFQs") at no cost. Buyers warrant that information submitted in RFQs is true and accurate, and that they are inquiring on behalf of a legitimate business need.

5.Seller responsibilities

Sellers warrant that all listings — including specifications, condition, photographs and pricing — are accurate and not misleading. Sellers are solely responsible for the products they list and for fulfilling commitments made to buyers. Listing prohibited or counterfeit goods is grounds for immediate termination.

6.Marketplace role

Machines Bazar is a discovery and inquiry platform. We are not a party to any transaction between buyers and sellers, do not take title to goods, and do not process payment for the underlying machinery sale. Disputes between buyers and sellers are resolved between those parties.

7.Subscription plans and credits

Sellers may purchase subscription plans that include monthly lead credits used to unlock buyer contact information on inquiries received. Credits are non-refundable but roll over while the plan remains active. Plan terms are governed by the pricing page in effect at the time of subscription.

8.Prohibited conduct

You may not (a) misrepresent your identity or business, (b) post false, misleading, defamatory or unlawful content, (c) attempt to circumvent platform fees or scrape data without permission, (d) interfere with the security or operation of the Platform, or (e) use the Platform for any purpose contrary to applicable law.

9.Intellectual property

The Platform, including its design, code, branding and content, is owned by Machines Bazar and protected by Indian and international intellectual property laws. Sellers retain ownership of content they post but grant us a non-exclusive, worldwide, royalty-free license to display and distribute such content on the Platform.

10.Disclaimers

The Platform is provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the accuracy of listings, the conduct of users, or the suitability of any machinery for a particular purpose.

11.Limitation of liability

To the maximum extent permitted by law, Machines Bazar shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits or revenues, arising out of your use of the Platform.

12.Indemnity

You agree to indemnify and hold harmless Machines Bazar, its affiliates, officers and employees from any claim arising out of your breach of these Terms or your use of the Platform.

13.Governing law

These Terms are governed by the laws of India. Courts at Mumbai shall have exclusive jurisdiction over any dispute arising from these Terms.
